What happens when a person seeks access to constitutional justice because of their identity, e.g., a person who is Indigenous seeks to challenge the constitutional validity of legislation that affects them specifically because they are Indigenous?  

In this presentation, Keyzer will explain how rules governing standing, non-party intervention (such as admission of amici curiae) and costs can exclude people from seeking access to constitutional justice on the basis of their identity. Why are these two such remarkably similar countries so remarkably different in their approaches to regulating access to constitutional justice?
